Electric Bike Test Ride Waiver and Release of Liability

Thank you for choosing Velowave for your e-bike test ride experience! We’re excited to help you explore the world of electric biking. Before you begin, please review the following terms. By submitting your information to participate in the test ride, you agree to abide by these terms.

E-Bike Test Ride Guidelines

We want you to enjoy a safe and fun test ride! Please note the following:

  • Speed Capability: E-bikes are equipped with pedal-assist and/or throttle systems that allow them to reach higher speeds than traditional bicycles. To ensure your safety, start your ride with the pedal-assist mode set to the lowest level or turned off entirely. Familiarize yourself with the e-bike’s handling before engaging higher speed settings.
  • Weight and Handling: Due to the battery and motor, e-bikes are heavier than standard bicycles, which may affect balance and maneuverability. Please ensure you feel comfortable and stable while riding.
  • Physical Fitness: Riding an e-bike requires a basic level of physical ability. Confirm that you are physically capable of operating and controlling an e-bike safely.
  • Helmet Requirement: You must wear a properly fitted bicycle helmet (Snell or ANSI approved) at all times during the test ride.

Terms of Participation

By participating in the test ride, you agree to the following:

  1. Acknowledgment of Risks: You understand that riding an e-bike, like all forms of cycling and physical activity, involves inherent risks, including but not limited to falls, collisions, equipment failure, or environmental hazards. These risks may result in serious injury, permanent disability, or death. You knowingly and freely assume all such risks, whether known or unknown.
  2. Personal Responsibility: You accept full responsibility for assessing the safety and suitability of the areas where you choose to ride during the test ride. You will exercise caution and adhere to all local traffic laws and regulations.
  3. Release of Liability: You release and discharge Velowave, its owners, officers, employees, agents, affiliates, or representatives (collectively, the “Releasees”) from any and all liability, claims, demands, losses, or damages arising from your participation in the test ride, whether caused by the negligence of the Releasees or otherwise, including but not limited to negligent instruction or assistance.
  4. Indemnification: If you, or anyone acting on your behalf, initiates a claim against any of the Releasees, you agree to indemnify, defend, and hold harmless the Releasees from any litigation expenses, attorney fees, losses, liabilities, damages, or costs incurred as a result of such a claim.
  5. Equipment Operation: A representative of Velowave will provide instructions on how to operate the e-bike, including:
    • Proper use of gears and brakes.
    • Operation of the pedal-assist system.
    • Use of the throttle (if applicable). You confirm that you understand these instructions and feel confident in your ability to operate the e-bike safely.

Participant Requirements

  • You are at least 18 years of age.
  • You have reviewed and understand these terms.
  • Your participation indicates your agreement to these terms to the fullest extent permitted by law.
  • If any portion of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • These terms are governed by the laws of Washington State.
